Limited Warranty

In the document detailing this LIMITED WARRANTY, we shall consistently refer to GreenFill LLC, which conducts its commerce under the name GRIPIN, as the seller. Throughout this text, GreenFill, LLC, trading as GRIPIN (henceforth referenced as "Seller"), pledges to the initial buyer (hereafter termed "Buyer") of the container chassis that, for a period of three (3) years commencing from the date the product is first put to use (the initiation of which is to be ascertained by GreenFill, LLC, operating as GRIPIN), the said product (denominated here as "Goods") shall be devoid of material defects and deficiencies in craftsmanship, given that the Goods are exploited in line with their intended design and subject to the Goods being subjected to appropriate maintenance. The phrase "USED AS DESIGNED" encapsulates the correct application of loading and transport of legally permissible loads that are evenly distributed, securely fastened, and non-corrosive in nature, being utilized on roads that are judiciously preserved. It is imperative that the Goods should, under no circumstances, be subjected to loads surpassing either the gross vehicle weight rating (GVWR) or the gross axle weight rating (GAWR) as duly inscribed on the vehicle registration plate that is installed on the Goods by the Seller. Should there be any instance of such overload, it will promptly invalidate this warranty.

This warranty becomes invalid if the products are not used for their intended purpose. The seller does not warrant parts, accessories, or other goods made by third parties that the buyer has specified or that are needed due to the buyer's specifications. Warranties received from the seller's suppliers for such items will be transferred to the buyer, without the seller endorsing or assuming them. No guarantees are provided for parts subject to wear and tear, including, but not limited to, brake components, oil seals, wheel bearings, paint, lighting, tarps, tires, and accessories. This also excludes damage from rust, routine maintenance issues not related to faulty parts and goods damaged by mishaps or unauthorized repairs.

Seller and buyer agree that the seller's only obligation for any defects in the purchased goods, regardless of whether the claim is based on the warranty or other legal grounds, is to either repair or replace the defective items, at the seller's discretion, provided that the goods are returned within a strict 20-day period from when the defect was or ought to have been noticed.

Warranty claims must abide by the Seller's Warranty Guidelines, and all repairs under warranty require written approval from the seller before any work can commence. Warranty claims will be denied if unauthorized costs are incurred or if the guidelines are not followed.

Any descriptions of the goods provided by the seller or seller's agents, through written words, specifications, samples, models, announcements, diagrams, engineering documents, or similar materials used during the order process, are merely for the purpose of identifying the goods and should not be seen as a formal warranty.

The warranty does not cover issues that arise from various specific causes, including sidewall bulge due to cargo pressure, natural deterioration, corrosion, improper use, negligence, product alterations by anyone other than the seller, repairs conducted by unauthorized third parties, not following the given manuals or instructions, failures of parts not provided by the seller, lack of proper maintenance by the buyer, overloading beyond the Product's weight ratings, or any other circumstances beyond the seller's control. The warranty is also nullified if any unauthorized parts are installed into the product. The warranty is only valid for the original purchaser from the seller or its authorized dealers, and it cannot be transferred. This warranty exclusively replaces all other warranties, whether they are express, implied, statutory, or otherwise, including those of marketability and suitability for a particular purpose. The seller is not liable for any indirect, incidental, or consequential damages such as lost profits, lost cargo, or business interruptions, regardless of whether the claim is based on contract, tort, or any other legal theory, resulting from the use of the products.

For structural components of trailers produced by GreenFill, LLC, doing business as GRIPIN, the warranty includes both materials and labor for three (3) years starting from the date the product is put into use, as recorded by GreenFill, LLC dba GRIPIN. Components supplied by GreenFill, LLC but produced by other manufacturers retain their original warranties as provided by those manufacturers. To the original buyer alone, GreenFill, LLC dba GRIPIN extends any warranty assurances it receives from manufacturers or suppliers of those components.

Certified Repair Centers

Warranty repairs should be conducted, whenever feasible, at a repair shop authorized by GreenFill, LLC. GreenFill, LLC will accept charges at certified repair shops not on its official network if there isn't a suitable shop nearby. Charges for work on GRIPIN container chassis must be reasonable.

Warranty Exclusions defined by GreenFill, LLC

Paint Variations: 1. Components from various suppliers might have slight differences in color. A corner post and side panel from two separate sources may not match perfectly, which is not covered by the warranty. 2. Incorrect paint color due to not receiving paint samples or special color requests that can't be matched precisely. Paint colors based solely on a code are not warranted.

Exclusions Based on Damages: 1. Damage from excessive force, exceeding normal loads, or overloading. 2. Loads exceeding specified capacity that aren't distributed evenly. 3. Usage on roads that are not properly made or maintained. 4. Damage from exposure to corrosive substances. 5. Damage due to improperly secured loads. 6. Corrosion from the use of non-approved cleaning materials. 7. Inadequate or incorrect maintenance and repairs. 8. Continuing to use the trailer after an initial failure, which should have been recognized during routine use and inspection, is not covered.

Non-Covered Components: 1. For tire issues, reach out to the local tire dealer. 2. For lift gate issues, consult the local lift gate dealer. 3. Items not fitted at the GreenFill, LLC factory. 4. Previously used parts given to GreenFill, LLC for vehicle assembly. 5. Components that wear down naturally over time and are expected to be replaced within the three-year warranty period, despite not being defective.

Examples of Excluded Parts: Brake pads, suspension bushings, springs, and engine bushings, among others, as detailed in the supplier's warranty guidelines.

Costs Not Included: 1. Lost cargo. 2. Revenue losses from equipment downtime. 3. Shipping or transport expenses. 4. Expenses for temporary fixes.

Warranty Restrictions: GreenFill, LLC reserves the right to modify warranty guidelines at its discretion. The warranty for components supplied by third parties is outlined by a separate schedule provided by GRIPIN for container chassis components. Any alteration to warranty terms can only be authorized by the President or Vice-President of Sales at GreenFill, LLC. Warranty coverage asserted by distributors or independent sales representatives beyond the official terms will not be acknowledged by GreenFill, LLC, and may place additional liabilities on the distributor or sales representative toward the customer.
